Can I receive VA disability benefits for migraines after a TBI?

Understanding the Link Between Migraines and TBI

A migraine is caused by abnormal blood flow to the brain. Migraines result in moderate to severe pain that is often described as throbbing or pulsing. They typically affect one side of the head and are often accompanied by symptoms such as dizziness, nausea, vomiting, and extreme sensitivity to light and sound.

About 30% of the people who experience ongoing headaches after a TBI have migraines. There is evidence to suggest that people with a family history of migraines are more likely to develop the condition after a TBI, but it’s possible to be affected regardless of your genetic risk.

Receiving VA Disability Benefit for Migraines

The VA evaluates migraines under CFR 38, the Schedule for Rating Disabilities, diagnostic code 8100. There are four potential ratings:

• 50%. A Veteran suffers frequent completely prostrating and prolonged migraines leading to severe economic inadaptability.
• 30%. A Veteran has migraines with prostrating attacks that happen an average of once per month over the last several months.
• 10%. Prostrating attacks average one every two months for several months.
• 0%. A Veteran has migraines, but the attacks occur infrequently.

In this context, prostrating means that a Veteran must lay down in a cool and quiet room and avoid any physical or mental activity until the migraine has passed. Medical treatment records, records indicating frequent absences from work, and statements from family or friends who are familiar with how often your migraines occur can help you maximize your rating.
